Two sections of this policy set out rights that apply only in one country. Go straight to the one that covers you:
Where this policy and one of those sections conflict, that section prevails for the people it covers.
What information we collect
We may collect the following:
- your name
- contact information, including email address, telephone number and postal address
- demographic information such as postcode, preferences and interests
- billing and delivery addresses, and the details of what you order
- payment information, which is processed by our payment providers rather than held by us
- account login details and marketing preferences
- vehicle details you give us so we can check fitment, such as make, model, year, variant and build date
- fitment and workshop booking details, where you book an installation through us
- other information relevant to customer surveys, warranty claims, returns or offers
- information contained in any image, photograph or review you submit to us
For the full list of cookies we use, see the list of cookies we collect at the end of this policy.
You may choose not to provide personal information, but this may prevent you from receiving certain features of the Services, including placing an order or booking a fitment.
We do not seek to collect sensitive information or special personal information, as those terms are used in Australian and South African privacy law, and we ask that you do not send it to us.
Information collected automatically
We also collect information that does not by itself identify you, including how you interact with the Services, information logged by websites when they are used, and information about your browser or device. Examples are the pages you viewed during a visit, the content or advertisements you interacted with, your language preference, and the city and region you are in, though not your precise location.
If we associate that information with information that identifies you, we treat it as personal information.
What we do with the information we gather
We need this information to understand your needs and provide you with a better service, and in particular:
- internal record keeping
- to process your order, take payment, arrange delivery and issue invoices and confirmations
- to arrange and manage a fitment or workshop booking
- to provide customer service, including fitment advice, warranty claims and returns
- to improve our products and services
- to periodically send promotional emails about new products, special offers or other information we think you may find interesting, using the email address you have provided
- to contact you for market research purposes from time to time, by email, telephone or post
- to customise the website according to your interests
- to prevent fraud and other misuse
- to manage and maintain the systems that provide the Services
- to comply with our legal obligations and exercise our legal rights
How we share your information
We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. We may use your personal information to send you promotional information about third parties which we think you may find interesting, if you have told us you wish this to happen.
We do share information with the following, so that we can run our business:
- Service providers. Companies engaged to perform functions on our behalf, such as hosting our websites, storing data, processing payments, delivering orders, sending our email and SMS communications, and conducting audits. We require them to use the information only to provide their services to us, or as the law requires.
- Payment providers. Card payments and services such as PayPal, Apple Pay, Afterpay and Zip are handled by those providers under their own terms and privacy policies. We do not hold your full card details.
- Delivery carriers, so your order can be shipped and tracked.
- Our fitment and workshop network. Where you book an installation, we share the details needed to complete it, which include your name, contact details, vehicle details and the products being fitted. Many of our fitment partners are independent workshops, and they handle that information under their own privacy practices.
- Within our group, where another Zeder company needs the information to support you or to operate a shared system.
We may also disclose your information where we believe in good faith that it is reasonably necessary to comply with a legal or regulatory requirement or an enforceable request, to enforce our terms, to protect the rights, property or safety of us, our customers or others, to submit or defend an insurance claim, or to detect, prevent or address fraud, security or technical issues.
If our business or the relevant part of it is sold, merged or transferred, or in the unlikely event of insolvency, we may transfer your information to the acquiring party. We will use reasonable efforts to notify you, for example by email or by posting a notice on our website.
Security
We are committed to ensuring that your information is secure. To prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. We use encryption when sensitive data is transmitted over the internet, and we restrict access to the personal information we hold to the people who need it to do their job.
No method of transmission over the internet and no method of storage is completely secure, so while we strive to protect your personal information we cannot guarantee its security.
How we use cookies
A cookie is a small file which asks permission to be placed on your device. Once you agree, the file is added, and the cookie helps analyse web traffic or lets the site know when you visit. Cookies allow web applications to respond to you as an individual, tailoring their operation to your preferences by gathering and remembering information about them.
We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our website to suit customer needs. We only use that information for statistical analysis, and the data is then removed from the system.
Cookies help us provide you with a better website by letting us monitor which pages you find useful and which you do not. A cookie in no way gives us access to your device or to any information about you, other than the data you choose to share with us.
You can choose to accept or decline cookies. Most browsers accept cookies automatically, but you can usually modify your browser settings to decline them. This may prevent you from taking full advantage of the website.
Analytics and advertising technologies
We also use third party technologies that help us understand how our sites are used and show you relevant advertising. These providers may collect information automatically, and their own privacy policies govern how they use it. We do not control their data practices, and some of them let you opt out directly.
Links to other websites
Our websites may contain links to other websites of interest. Once you use those links to leave our site, we have no control over that other website. We cannot be responsible for the protection and privacy of any information you provide while visiting such sites, and this policy does not govern them. Please exercise caution and read the privacy statement applicable to the website in question.
Controlling your personal information
You may choose to restrict the collection or use of your personal information in the following ways:
- whenever you are asked to fill in a form on the website, look for the box you can tick to indicate that you do not want the information used for direct marketing purposes
- if you have previously agreed to us using your personal information for direct marketing, you may change your mind at any time by emailing us at [email protected], or by using the unsubscribe link in any marketing email
It may take a short period for an opt-out to take effect. Even after you opt out of marketing, we may still send you messages about an order you have placed or a booking you have made.
Access, correction and deletion
You may ask us for a copy of the personal information we hold about you, ask us to correct it if it is inaccurate or incomplete, or ask us to delete it. Email [email protected], or write to the office for your region shown above.
We may ask you to verify your identity before we act on a request. We may need to keep some information for a limited period to meet our legal, accounting, warranty or dispute resolution obligations, and we will tell you if that applies.
The time limits, the grounds on which we can refuse, and whether a fee may apply differ between Australia and South Africa. See the section below that covers you.
If you are in Australia
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Fulcrum Suspensions Pty Ltd is responsible for your personal information.
Dealing with us anonymously
You can browse our sites without telling us who you are. We need your personal information to take an order, deliver it, arrange a fitment, handle a warranty claim or answer a question about your account, so those things cannot be done anonymously or under a pseudonym.
Access and correction
You can ask for access to the personal information we hold about you, and ask us to correct it, by emailing [email protected] or calling 1800 385 278. We will respond within 30 days. We do not charge you for making a request. If we refuse access or refuse to make a correction, we will tell you why in writing and explain how you can complain about that decision.
Direct marketing
You can ask us to stop sending you direct marketing at any time, using the unsubscribe link in any marketing email or by emailing [email protected]. We will action the request and will not charge you for it.
Sending your information overseas
We are part of a group operating in Australia, the United States, the United Kingdom and Vietnam, and some of our service providers are located overseas, including in the United States, the European Union and South Africa. Your personal information may be disclosed to those countries so that we can operate our sites, process your order and support you. We take reasonable steps to ensure overseas recipients handle your personal information in a way consistent with the Australian Privacy Principles.
Government related identifiers
We do not adopt a government related identifier, such as a tax file number or driver’s licence number, as our own identifier for you.
Data breaches
If a data breach involving your personal information is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner, as the Notifiable Data Breaches scheme requires.
Complaints
If you have a privacy complaint, email [email protected] or call 1800 385 278 and we will respond within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at https://www.oaic.gov.au, by calling 1300 363 992, or by writing to GPO Box 5218, Sydney NSW 2001.
If you are in South Africa
We handle personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).
The responsible party for formula4x4.co.za is 4x4 Wholesalers Africa (PTY) LTD, our distributor in South Africa, of Centurion Warehouse, 1 Hilda Ave, Hennopspark, Centurion, Gauteng 0172.
How we may process your information
We process your personal information only where POPIA allows it, which is where you have consented, where it is necessary to carry out a contract with you, where the law requires it, or where it is necessary for our legitimate interests or yours. We collect it directly from you wherever we can.
Your rights
As a data subject you have the right to:
- be told that we hold personal information about you, and to ask for a copy of it
- ask us to correct or delete personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully
- object, on reasonable grounds, to us processing your personal information
- object at any time to your personal information being used for direct marketing
- not have a decision made about you based solely on automated processing, where that decision has legal consequences for you
- complain to the Information Regulator
To exercise any of these rights, email [email protected] or write to the address shown above. POPIA allows a responsible party to charge a prescribed fee for giving access to a record, and we will tell you the amount before we proceed. We do not charge you for asking us to correct or delete information.
Direct marketing
We will only send you electronic direct marketing where POPIA permits it. If you are not already a customer, we will ask for your consent first, and we will only approach you once for that consent. If you are a customer, we may send you marketing about similar products, and you can opt out at any time at no cost, including in every message we send.
Sending your information outside South Africa
Your personal information may be transferred to and stored in Australia, and in other countries where our group companies and service providers operate. We will only transfer it where POPIA permits, which includes where the recipient is bound by rules or an agreement that provide an adequate level of protection, where you have consented, or where the transfer is necessary to perform a contract with you.
Security compromises
If there are reasonable grounds to believe your personal information has been accessed or acquired by an unauthorised person, we will notify you and the Information Regulator as soon as reasonably possible, as section 22 of POPIA requires.
Complaints
If you have a privacy complaint, email [email protected] or call +27 41 260 0603 and we will respond as soon as we can. If you are not satisfied with our response, you may lodge a complaint with the Information Regulator (South Africa). Their current contact details and complaint forms are published at https://inforegulator.org.za.
Children
Our Services are not intended for people under 18 years of age. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us with personal information, contact us at [email protected] and we will delete it.
Changes to this policy
We may change this policy from time to time by updating this page. You should check this page from time to time to ensure you are happy with any changes. You can always check the “Last updated” date at the top of this page to see when it was last changed. If we make material changes we will notify you by reasonable means, which may be by email or by posting a notice on our websites.
